However, I did not receive one of the enclosures you claim to have included in your letter, and I have some questions about the broad release you requested I sign. Over the course of the last few weeks I have left several messages for you at your office to this effect, asking that you call me to discuss these matters. I have yet to receive a response from you. Part of what I wanted to discuss is that fact that I am engaged in federal litigation with the cult of scientology, and precisely how that effects my concerns about the release. Because Allstate has in the past been closely linked to the cult, and because my counter-claims against the cult involve their violations of my privacy and civil rights, I am hesitant to give Allstate permission to potentially violate my privacy further, perhaps on behalf of the cult. Since you have not deemed to return my calls, I have had cause to wonder if you intend to deal in good faith with my claim. My claim is as follows: On February 1, 1999 around 11:30 AM I was proceeding south on the sidewalk of the east side of Central Ave. in Glendale, CA, on my bicycle. When I reached the corner of Garfield and Central I noticed a woman who later identified herself as XXXX XXXXXXXX(CA drivers license #Bxxxxxx) driving a green Toyota Rav 4 (CA license #xxxxxx) registered to your insured, XXXXX XXXXX(Dearbourn policy #xxxxxxxxxxxx). She had been traveling west on Garfield. When I observed her, she was stopped at the intersection, apparently waiting to turn onto Central. I noticed particularly that the woman was looking south, intently watching the traffic traveling north on Central. She was clearly waiting until it would be safe for her to proceed onto Central. Since there was considerable traffic coming north in all lanes of Central, and knowing that she could thus not make any turn, I proceeded on my bicycle into the crosswalk. Still looking south (ie. without even glancing straight ahead or to her right) Ms. Airapetian proceeded to drive the vehicle into the crosswalk, striking me on my bicycle with the front bumper and knocking me and my bicycle to the ground. The bicycle was crushed under the vehicle and I barely managed to get out from under before being likewise crushed. My right leg was injured with a raw scrape and bruise on the shin. My ankle was also injured with a sprain and minor fracture. The bicycle was unridable because as a result of being hit and crushed under the car, the pedals were destroyed, the rear wheel was bent and unable to turn, the rear brake housing was broken off, the deraillier was destroyed and the seat was torn. Ms. XXXXXX attempted to leave the scene of the accident without giving me any information. Only after blocking her departure and demanding it repeatedly did she give me her license, registration and insurance information. The information she gave me regarding her insurance coverage turned out to be false. She was driving without liability insurance. After initially asserting that her hitting me was my fault, lying that it was I who was not looking where I was going, and telling me I was not hurt, Ms. XXXXXX finally apologized for her negligence and offered to pay for my trashed bicycle. As I said earlier, I have, over the past several years, been pursued, harassed and stalked by agents of the scientology cult. Even as recently as a week prior to the February 1st incident, I believe they had tried to stage an accident with me on my bike. Since Ms. XXXXXXXX's behavior was erratic and rude, and because I considered the possibility that the accident had been staged by the cult, I opted to have the police called and to have a report filed. A bystander called the Glendale police and soon two motorcycle officers arrived on the scene to take a report. The report number was 99-XXXX by officer XXXXXXXXXX of the Glendale Police. The above events were witnessed by XXXX XXXXXXXX who was walking in the vicinity of the accident at the time I was hit and remained at the scene to make a report to the police. My bicycle was unridable and since I was badly shaken and limping, the motorcycle officers called for a black and white Glendale Police vehicle to take me home. The bike was loaded into the trunk of the police car, and I was driven home by the Glendale police officer. By morning of following day my ankle had become swollen, so I went immediately to the emergency room at Kaiser Hospital on Sunset Blvd. in Los Angeles. X-rays were taken of my swollen ankle and bruised shin. The emergency room doctor, Dr. XXX XXXXX (? illegible), said I had a fracture of the ankle and placed my right leg in a cast, from toes to just below the knee. In attempting to track down the driver's insurance carried, I found that Ms. XXXXXXXX had given both me and the police false information. I finally managed to talk to the wife of the owner of the car, Mrs. XXXXXXXX, and after several follow-up calls was given the correct insurance company. When I contacted Allstate/Dearborn I was given a claim number and promptly received a call from XXXXXX XXXXXX. Within days I received the above referenced letter from Ms. XXXXXX which was missing one of the enclosures she claimed to have included. About that same time XXXXXX XXXX, a photographer from Allstate, came to my home and photographed the damaged bicycle. Included with the February 11, 1999 letter sent by Ms. XXXXXX was a broad release for me to sign and return. The release would basically give Allstate Insurance permission to investigate my entire medical history, contact any and all employers, investigate me regarding insurance fraud and supply information about me to any other investigatory organizations or insurance companies regarding any past or future claims I might make. While this type of release might be appropriate in claims where a serious permanent physical disability was inflicted upon a claimant and where wages were lost due to the injury, it is clearly beyond the scope of anything required to settle my claims. Additionally my concern is that Allstate has been closely linked to the cult of scientology, which is the plaintiff in the federal case (Religious Technology Center and Bridge Publications vs. Dennis Erlich - Northern District of California - Case # C-95-20091 RMW EAI) in which I am the defendant. My counterclaims in this case arise from serious infringements to my privacy and civil rights. From the wording of the release, Allstate appears to be requesting my permission to launch into whatever investigation of me is needed in order to discredit my claim, just as the cult of scientology already has done. Because there has been a clear public link between the cult of scientology and Allstate, and because my case against the cult involves issues of privacy, I would not feel comfortable signing away any of my rights without advice of counsel. In the past several years I have been harassed, followed and stalked by agents of scientology. These incidents were reported to the Glendale Police. Although I have no evidence to support my suspicions, it crossed my mind that this incident might have been connected with earlier incidents of harassment or stalking, and could actually have been staged by the cult. Inasmuch as I currently have no attorney representing me in this claim against Allstate's client, I want to give you an opportunity to deal with my claim in good faith before retaining counsel to review the implications of signing such a release as requested. I believe your client is liable for my costs in replacing my bicycle and for the pain and inconvenience caused by the negligence of the person driving your client's vehicle.
