He sent me the following e-mail: ------------ You can let people know that despite making all my child support payments, even tho unemployed, and having support amount $375 per month based on an "attributed income" assigned to me of nearly double what I was collecting in unemployment, the San Diego court in March of this year, found me of contempt for paying (allegedly on 8 occassions) my child support late, tho still in the same month it was due. The judge sentenced me to the maximum of 5 days in jail for each count - 40 days in the county jail, suspended sentence. This sentence would be served if I didn't follow all existing court orders for one year. The ruling is currently under appeal. For objecting to invasive questions on an interrogatory from my ex's scieno-paid lawyer, my 'probation' is going to be revoked and I am going to be sentenced to 40 days in the same jail in which my ex-wife's new husband serves a sheriff. There is no doubt in my mind that the scientology cult, with the help of a vindictive ex-wife has and will continue to attempt to have me incarcerated. I have made every required support payment and more. I still have a $40k plus bill for the years my vindictive ex-wife hid the child from me and thwarted visitation. She came out of hiding to give the scienos a declaration they needed to satisfy the federal statutes permitting them to kick down my door and rape my privacy without letting me tell my side of the story in court before the court ordered the seizure. The scienos helped her in return by giving her my bank account # from my bank statement information stolen from me during the unconstitutional raid. And by paying, I am certain, for the Century City lawyer who has appeared against me in San Diego at least half a dozen times. They have done everything they could to have me found in contempt. The litigation has no doubt cost them in excess of $20k since the raid. They managed to get me found guilty of 8 counts of contempt. The violation was for paying my child support ~later~ than the date the court ordered, though still in the same month. In the other hundred or so counts where I had ~not paid child support at all~ due to not knowing where my ex wife was hiding the child, I was found NOT guilty. In this particular threat, they claim that I have violated my 'probation' by failing to abide by a non-existent court. The order, they claim, requires that I report to them the complete details of my efforts to find employment. No such order exists, and the lawyer knows this. Yet he can pretend that one does and bamboozle judges into ruling against me until I can ~prove~ to a judge that no such order exists. I can prove this. The judge who didn't issue the order actually refused to issue it when it was suggested by Rosa's lawyer. But in any case, I stand a snowman's chance in hell of getting the brand new judge (I've had half a dozen) to take the time to allow me to convince him that the order ~doesn't~ exist. The scientologists are great at creating these legal Catch-22's. But I digress. I have a new job. I am working for Tribune Broadcasting as assistant to the producer of the Hollywood Christmas Parade and Rose Parade telecasts on KTLA channel 5 in LA. Still, I cannot afford to defend myself. As you probably already know, in this system one only gets as much "justice" as he can afford to purchase. I don't know how much of this rightly belongs on the net. If you feel it does, just go ahead and post it. It is only a net.matter to the degree that it effects me and I am 99% sure that the scienos are financing this nutty barrage of litigation against me to weaken my position so I will be less credible in the net.censorship case where The Mighty MoFo (Morrison & Foerster) is defending me pro bono. Anyway, enough about me. I certainly could not have withstood their legal (and extra-legal) onslaught without it. I am working now for (Chicago) Tribune, Inc., owner of KTLA Channel 5 in LA as Assitant to the Producer of the Hollywood Christmas and Rose Parade telecasts. On Sunday, December 1st, from 6pm to 8pm (pacific time) we will be staging and broadcasting the Hollywood Christmas Parade (formerly known as the Santa Claus Lane Parade - as in the song "Here comes Santa Claus ...") Tribune has thrown up a web site (their first?) to promote the parade. Their "float" is well back, toward the end of the parade, for anyone who will be able to tune in. The following Monday I will have to be in front of yet another new San Diego County Family Law Court judge and answer to the motion to revoke my 40 days in jail suspended sentence for paying my child support later than the due date. I am not a lawyer. I didn't really understand all that happened, so if you are looking to understand the entire case, you will need to continue your search. I can only tell you what I saw and heard, and perhaps that will be good enough. I arrived at about 12:45 for the 1:45 start of the hearing. The case was listed first in a list of about 4 or 5 that were being heard by Judge Edward B. Huntington. I sat for a while with Kevin, Dennis and Dennis' mother, who I found to be a tremendous listener and pleasure to be around. She never once complained about the level of Internet and Scientology jargon that we threw around in conversation. The opposition was Scientology lawyer Fred Silberberg. Although I have no direct evidence, I assume he is a Scientologist, not a hired gun. For one thing, he is not local, he's from Los Angeles, apparently with expensive offices. For another, at one point he tried to tell Kevin that his handwritten notes were "sealed". For a third, he lied in court concerning the process serving. But let's wait to explain that a little later. He carried a Dell notebook computer (frequently consulted), a large cardboard box, a large black leather case, and a large brown leather case. He thought he came prepared. Life is full of surprises. I neglected to get a picture of him, but he's somewhat tall, quite thin, with a very angular face. Dark hair swept straight back. I'll follow the tradition of describing his suit: gray with a small check pattern, blue tie with a kind of flowered pattern. He wore a wedding band. Rosa was there. She is young looking, looks 35 but perhaps as old as 40. Thin, but not unhealthy. Hispanic looking, with black hair piled up in a bun. The Katherine Janeway look, I suppose. She wore gray also. Her significant other was also there. He has gray hair, a gray clipped moustache, wore a satin jacket with "San Diego Sheriff Vice" on the front. He reminds me of "Cliff" from Cheers. He chewed gum and wore a beeper. Hey, I noticed these things, so now you know also. Dennis was also represented. In the last few weeks enough contributions have come in to hire a lawyer from Los Angeles. I won't describe the lawyer other than to say that there is some experience with Scientology, which is good. Please don't bug me about this, because I won't give in. Hereafter "DL" will mean "Dennis' Lawyer". From what I've managed to piece together, Dennis has been paying the monthly awarded child support. It's the back money that's at issue here, and it's a lot of money. For reasons I don't understand, Dennis is on probation because of this. I don't recall there being a trial, but there it is. The cult wanted Judge Huntington to revoke his probation and send him to jail for 40 days. Previous to the hearing, DL filed opposition papers to this request, claiming that it was groundless. Apparently there is an order for him to pay support, but no order as yet about the arrears that he is violating, DL claims. The judge began by asking how long the proceedings are likely to take. DL said 5 minutes. Silberberg said 30 minutes. The whole court staff and lawyers present chuckled at that. DL said there is no dispute of the facts, and the judge could decide this motion summarily, Silberberg didn't think so. The judge asked if they had talked about a settlement, which they hadn't. He told them to go out and discuss, which they did for all of 2 minutes before returning. When they got back around to Dennis' case, the judge didn't see a motion that he was being asked to decide. Silberberg gave him a copy, saying it was filed on the 21st at the judge's direction. The Judge asked if Judge Clements heard the matter. This is the first I heard of Judge Clements, so I guess I haven't been following along well enough. I didn't want to take up any of DL's time to quiz about exactly what was happening beforehand, so there we are. Judge says "I have Mr. Erlich's supplemental response to special interrogatories". Kevin later tells me they had a long list of overly personal questions, supposedly related to why he was unable to pay the arrears. Judge: "Do you have proof of service?" Aha! Silberberg: "That was filed separately. I'm looking for it, your honor". He looks. He looks. DL says Dennis was not personally served. Judge: "If you're asking to throw him into jail, you have to dot _every_ i and cross _every_ t. If you served him by mail, then you didn't make it." So much for the three box theory. Silberberg: "I believe it was sent with a messenger and left at the residence." Dennis "That's a lie." I smell clams. Silberberg asks for a continuance, DL talks about how the motion has no merits anyway, and if there's to be a continuance, then legal fees and transportation should be provided by the other side. Judge: "If you want to argue fees, that's the risk you take coming down from Los Angeles." DL: "I will have to confer with my client to see if we will waive service." More arguing back and forth that I didn't understand, finally the judge says "Folks, you're not gaining any ground here. This is Judge Clements' order, not mine." Again, with Judge Clements. He holds up a 6" thick folder. "This file is indicative that nobody has talked to each other." Everybody goes back out to the lobby. Silberberg gets on the cellular. Then he looks around, and goes outside to continue the call. Apparently he thought we would overhear. Eventually, we go back inside. The judge says he talked to Judge Clements. Clements will have to do the revocation of parole. Silberberg goes back to the service, claiming it was mailed, and he has proof of service. Too late, everybody has to go to Judge Clements. Judge Alan Clements has the room next door down. He is the judge that put Dennis on probation. When it gets around to the case, he asks "Nature of the motion?" Silberberg: "Revocation of probation. Time estimate: 30 minutes." DL talks about how this is an issue of law, that the facts are not in dispute, that the payments are being made, and there are no orders being violated. The arrears were frivolous anyway, because there was no income during that time. There is no pending order on arrears. Judge: "Time estimate?" DL: "Your honor can decide summarily." The judge decides not to do that. He sets aside one hour, on January 2nd at 8:45 a.m. That's all folks. Did Dennis gain anything here? I don't know. Perhaps a few weeks of freedom, or perhaps a few weeks to still worry about this thing. The funds that brought DL down from LA are gone, I think. I don't yet have an address to which any more can be sent. Why did the service issue suddenly go away? I don't know. Why was Judge Huntington involved in the first place if it was Clements' order? These are things we were not meant to know. I hope the lawyer types in the crowd can figure out the missing pieces based on previous postings. I doubt it's in Dennis' interest to comment at this point, and I didn't distract DL just to satisfy my curiosity. I really tried to stay out of the way and not cause any trouble. I didn't talk to Rosa, the cop, or the clam lawyer. I was mostly there so Dennis felt like people care about this case, and we do. I think he appreciated the company, and we had a real nice dinner afterwards. I hope this prompts people to go out there early on January 2nd.
